1. Definitions

The following definitions apply when these terms are used in this Privacy Notice. If a term is not defined in this Privacy Notice, it is defined in the Terms.

a. Applicable Data Privacy Laws

Canadian residents, and/or California, Colorado, Connecticut, Utah or Virginia, residents may have certain privacy rights under Applicable State Privacy Laws  or in a Canadian province as described under our “What are your privacy rights under applicable data privacy laws and how do i submit my related request?” section below. These laws will be collectively referred to as Applicable Data Privacy Laws throughout this Privacy Notice.

b. Applicable State Privacy Laws

California, Colorado, Connecticut, Utah or Virginia, residents may have certain privacy rights under the applicable state laws as listed in our “What are your privacy rights under applicable data privacy laws and how do i submit my related request?” section below. These laws will be collectively referred to as Applicable State Privacy Laws throughout this Privacy Notice.

c. Aggregate Data

A subset of Non-Personal Information that we collect about a group or category of consumers, customers, employees or Products. Aggregate Data helps us to understand trends so that we can better consider new Products, analyze usage, facilitate payments, or otherwise improve or tailor our offerings. For example, we may collect Aggregate Data about the shopping habits of residents of a particular state (without linking this data to any specific Personal Information about those residents).

d. Internet Protocol Address ("IP Address")

A unique number that allows computers attached to the Internet to know where to send you data (such as the webpages you view) and where the data that you are sending is coming from.

e. Non-Personal Information

Information that does not identify you as a specific individual, including without limitation anonymous usage statistics including frequency of messaging and interaction with other users, clickstream data other log file data, or social analytics and tracking measurements. Where we link your Non-Personal Information to your Personal Information, in combination, it would become, and would be Processed as, Personal Information.

Information that identifies, relates to, or could reasonably be linked with you or your household (e.g., your name, social security number, email address, records of products purchased, internet browsing history, geolocation data, fingerprints, and inferences from other personal information) that could create a profile about your preferences and characteristics.

Your Personal Information does not include information that we obtain in or transform into an anonymous format which cannot reasonably identify you. However, if we collect Non-Personal Information and link it to your full name or other type of Personal Information, the combination of this data would be Personal Information.

g. Process or Use

Access, align, alter, adapt, amending, change, classify, collect, combine, communicate, delete, destroy, disclose, disseminate, export, handle, interact with, gather, group, lock, make available, manage, obtain, organize, request, receive, record, release, rent, retain, retrieve, process, sale/sell, save, share, store, test, track, transfer, transmit, transform, transport, treat use, secure, view, touch, or otherwise handle an individual’s Personal Information within our company or among our affiliates, partners or to our trusted service providers within the United States or internationally.

i. Sensitive Personal Information, Sensitive Data or Sensitive Information

Information that is a subset of Personal Information that includes 1) certain government identifiers (such as social security numbers or national identification); 2) an account log-in, financial account, debit card, or credit card number with any required security code, password, or credentials allowing access to an account; 3) precise geolocation; 4) mail/email/text message contents; 4) genetic data; 5) biometric information processed to identify a consumer; information concerning a consumer’s health, sex life, or sexual orientation; or 6) information about racial or ethnic origin, religious or philosophical beliefs, or union membership.

j. Sell  and/or  Share

Under California law, "share" means disclosure of your Personal Information by us to a third party for cross-context behavioral advertising, in exchange for money or anything else of value. So, when we use the term "Share" in this Privacy Notice, we are using it in the narrow meaning of how it is defined under California law. Other Applicable State Privacy Laws do not use the term "share," but describe the concept as using Personal Information for targeted advertising.

Under the laws of California, Colorado, Connecticut and Utah, "Sell" means exchanging your Personal Information by us with a third party for money or anything else of value. Under Virginia law, "Sell" is the exchange of Personal Information for money only. We use certain service providers in order to better understand our users’ needs and to optimize our Site and experience (e.g., how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.). This enables us to build and maintain our Site with user feedback. These service providers store this information on our behalf in a pseudonymized user profile and they are contractually forbidden to sell any of the data collected on our behalf.

To facilitate the delivery of relevant content, some cookies we use are for ‘Google Analytics’. Those are used to identify how users engage with our Site and to provide us with interest and demographic information regarding Site visitors. In addition, the feature of our purchase process that auto-populates addresses when you begin typing them into our order form implements functionalities that are enabled by Google Maps APIs. By using those features or functionalities, you are bound by Google’s Privacy Botice with respect to those features or functionalities.    We reserve the right to share with service providers, for any reason not disclosed above, any Non-Personal Information, including Aggregate Data. 9. How Long Do We Keep Your Information?

  1. maintain an internal data retention policy, which reflects retention schedules that are reasonably necessary and proportionate to achieve the purposes for which data was collected as describe in our section “What purpose and legal bases do we rely on to process your personal information and how do we process your personal information?“ above.
  2. will delete or anonymize data in accordance with that policy when we have no ongoing legal basis to Process your Personal Information, but we may need to keep information longer in certain circumstances, such as when it is required for legal compliance (e.g., tax, accounting, or other legal requirements).

10. How Do We Help Protect Children?

We adhere to a strict privacy code regarding children’s information. As part of that code, we do not knowingly collect, accept or otherwise Process Personal Information from children under the age of 16 without explicit parental or guardian consent. If we are made aware that we have unknowingly received Personal Information from or about a child under 16 without parental consent, we will remove it from our records.
